  • Rescind a contract: The unwinding or unmaking of an agreement or transaction.
  • Precedent - A binding previous judgement. It is a starting point and a guide for judges to base further judgement. It is flexible. 
  • Stare Decisis - let it stand. Similar or same decisions of the past will absolutely bind a court. But it is still flexible. In reality it is not absolutely binding. The court begins its analysis based on cases of the past and reconcile their opinion today.

  • Conjunctive - all elements of a statement must be satisfied 
  • Disjunctive - Only one element of a statement needs to be satisfied. 
  • Compare: Find similarities
  • Contrast: Find differences
